Sample Arbitration Clause

You can add an arbitration clause to your agreement to use Mediation and Civil Arbitration, Inc. d/b/a RapidRuling (“RapidRuling”) as your forum to settle disputes to avoid court.
SAMPLE ARBITRATION CLAUSE
Any dispute, controversy, or claim arising out of or relating to this agreement, or the breach, performance, termination, invalidity, or any other aspect thereof, shall be resolved by binding arbitration administered by Mediation and Civil Arbitration, Inc. d/b/a RapidRuling (www.rapidruling.com) (“RapidRuling”) conducted under RapidRuling’s prevailing Commercial Arbitration Rules effective on the date a claim is filed. Judgment on the award rendered by the arbitrator(s) may be entered in any court of competent jurisdiction. The arbitrator(s) shall be appointed in accordance with RapidRuling’s Commercial Arbitration Rules. The place of arbitration shall be Dallas, Texas and any hearing shall be held via video or telephone conference. The parties knowingly and voluntarily waive any objection to the decision, order, or award of the RapidRuling tribunal following disposition of the claim on the grounds that the hearing was conducted by video or telephone conference. The parties hereby expressly waive personal service of process, waive substitute service of process, and consent to electronic service of process via e-mail, effectuated upon the parties by e-mail to the following e-mail addresses [PARTY 1 E-MAIL ADDRESS] and/or [PARTY 2 E-MAIL ADDRESS]. All such e-mail service of process may come from the opposing party’s e-mail address listed here, or from efile@rapidruling.com. The parties shall designate all specified e-mail addresses as approved senders in their email systems and shall implement reasonable procedures to monitor incoming email, including spam and junk folders, each business day. This agreement shall also be binding upon all agents, successors, and assigns of the parties hereof.
