What is Online Dispute Resolution (ODR)?

Online Dispute Resolution is a type of alternative dispute resolution in which people with a dispute communicate online to resolve a conflict. With ODR, individuals have the power to develop solutions that meet the expectations and needs of both parties.

ODR services range from online arbitration to fully automated online “random bidding” negotiation services and chat-based mediation platforms. The preference for the appropriate ODR platform depends on the nature of the conflict and the parties involved. ODR procedures should also be convenient for the parties and not be of accessibility concerns.

The there main types of dispute classifications within ODR

  • Business to Business (B2B)
    Business to Business (B2B) disputes are two commercial parties seeking to resolve a dispute over a specific transaction. The parties in B2B tend to be professionals, and there is typically less concern over party exposure and a more significant focus placed on the convenience and expertise of the process. 
  • Business to Consumer (B2C)
    Business Consumer (B2C) disputes are becoming more standard, particularly with the growth of e-commerce. B2C disputes are typically low-cost but high-volume. 
  • Consumer to Consumer (C2C)
    Consumer-to-consumer (C2C) disputes between two consumers. These e-commerce transactions are becoming more familiar with websites such as eBay or Craigslist acting as facilitators between two parties, although the website is not an actual party to the dispute.

Why Use ODR?

The primary purpose of ODR is to allow the parties to resolve their dispute using electronic technology. It may occur in real-time, depending on the rules of the ODR Provider, as well as the wishes of the parties. This process is often more convenient and cost-efficient than face-to-face meetings to negotiate, mediate, or resolve existing disputes.

The agreement terms that the parties come to can be as broad or as specific as the parties desire, mainly if the matter is concluded at the negotiation or mediation phase. The enforceability of the settlement agreement may depend on the rules and jurisdiction of the ODR Provider, mainly if the dispute is international.

Advantages Of Online Dispute Resolution

  • One of the advantages of ODR is that resolution is fast. The court system is overloaded and cannot carry a trial for every lawsuit. As a result, a legal case can take several years to go to trial. Sometimes, a settlement or arbitration award can be reached within weeks of filing an ODR claim.
  • ODR is a generally informal, flexible, and creative dispute resolution tool that is not governed by strict rules of procedure and evidence. This may allow the parties to design or participate in a process that can be molded to suit their needs and encourages a consensual rather than an adversarial approach.
  • ODR reduces litigation costs; this is important to corporate parties who wish to keep costs down and to parties who otherwise might not be able to afford the cost of litigation

Disadvantages Of Online Dispute Resolution

  • All parties must have adequate technology to participate in an ODR Process. Parties without adequate technology may be disadvantaged or unable to participate fully.
  • Parties with language and/or difficulties communicating in writing may be at a disadvantage in an ODR process.
